Wal-Mart supermarket chain now faces serious trouble in the USA because of a CD by the nu-metal band Evanescence. After the parents of a 13-year-old in the US state of Maryland heard that the word 'Fuck' can be heard on the album "Anywhere But Home", they instructed their lawyer to have the sales stopped. The outraged father commented on the case with the words: "It must be removed from the shelves to prevent children from hearing it". Furthermore, he wants to claim damages of $74,500 (approx. €62,000) for each buyer of the CD. Also, the record company BMG Entertainment, which released this CD, should be taken to court.
Wal-Mart maintains a special department for checking product safety. According to official statements, however, it allegedly had no knowledge of the occurrence of this word in the lyrics of the song "Thoughtless" (Thoughtless), and a warning label on the CD sleeve is missing. The plaintiffs are trying to refute this by claiming that, in a free sample on the Wal-Mart website, this word is indeed censored.
Wal-Mart itself currently does not intend to remove the CD from its assortment.
