Concert promoters are facing tough challenges in this country. The Resist to Exist Festival is currently in trouble due to the regulations imposed by the building authority of the Oberhavel district. According to the authorities, it is no longer possible to hold the festival under these conditions. The promoters' lawyers see it quite differently, which is why they will take action against this order.

“Resist to Exist” 2019 in Kremmen on the brink? Why we are taking the case to the Administrative Court of Potsdam
During the ongoing preparations for the self-organized, non-commercial punk rock festival “Resist to Exist” on the first weekend of August 2019 in Kremmen (Oberhavel district), the organizing association alternati e.V. received a costly order from the lower building authority of the Oberhavel district. The costly order for the site on Oranienburger Weg (16766 Kremmen) prohibits the use of agricultural buildings, the designation of tent areas, the erection of tents for overnight stays, the establishment of sales stands, and the fencing of the site with construction fences under penalty. De facto, this makes the execution of the youth cultural event, which has been taking place in Kremmen since 2016, impossible.
According to the non-profit association alternati e.V. and its lawyers, the legal opinion of the lower building authority is not in line with the Brandenburg Building Code (BbgBO). Therefore, the association will initiate an expedited procedure before the Administrative Court of Potsdam to ensure the execution of the 16th “Resist to Exist” from August 2 to 4, 2019, in Kremmen.
Wolfgang Kunwald, technical director of the festival: “We find it incomprehensible how the lower building authority can speak of a structural change of use of the buildings, as we are merely transforming a shelter for cows temporarily into a provisional canteen for our helpers. And with a festival duration of three days, one cannot speak of building law interests. Otherwise, every other event in Kremmen and the surrounding area would only be possible if a comprehensive building application were submitted beforehand.”
Since September 2018, Mr. Kunwald and the organizing team have been working to implement comments and suggestions from the lower building authority: Together with a renowned landscape architecture planning office, the festival's organizing association has initiated a procedure to amend the development plan, a very time-consuming and costly process in planning and execution. In this context, representatives of the festival presented the plans in January 2019 with broad support from all factions in the relevant committees and in the local city council.
Jule Winter, member of the festival's organizing crew: “For years, cooperation with the local authorities has been working wonderfully. Only the lower building authority in Oranienburg is obstructing, even though their legal assessment is considered incorrect by our lawyers. The festival makes an important contribution to cultural diversity in the region, and we actively support youth work locally with our efforts. Showing attitude is the motto, and that’s why we are now reaching out to the public!”
